All,

I just received my e-mail notification for my Top 10 finish in the SW Premier League game. It states that the TV will not get to me for 3-4 months and so they are offering an option to have a different prize of $600 !!!! This sounds ok but it clearly states in the rules that the prize will be $1,000 and Motley Crue received the $1,000 cheque for the Brazilian game, I feel a bit cheated now after putting in all the work for around £400. El Tel, would you be happy with this ?? I hope this does not sound greedy but it has pissed me off a bit because in all correspondence with SW they have stated it was $1,000 !!

Well,Dai,it's a relief to know something is going on.Personally I have heard nothing as yet.Just checked the site and I am still 10th,but the Prizes panel is disabled,so I can't check the wording or eligibility.I never did understand how or why televisions for a global game-what with delivery and different systems.I'll think about $600 if and when the offer is made-no strong opinions,since I have a newish Sony and nowhere to put another-it would equate to the price in a private sale,I suppose.

Know any attorneys? Seriously, though, what can you do besides accept the offer? Maybe reject the smaller prize and insist on the one stated in the rules. I would definitely complain alot.

I guess that's what happens when SW gets bought out in the middle of a game.

I have sent them an e-mail to see what they say but I don't fancy my chances. I will take the $600 and I am chuffed with that but they said it would be $1,000 and now they say it is $600, they piss me off so much sometimes.

El Tel, it is quite worrying that they have not yet sent you an e-mail as they say I have to reply by Friday or I give up my prize !! Did you register your team under a different e-mail address ?

My e-mail has been constant with Smallworld,Dai.As I said in the other thread I was contacted by them for a shipping address and a shirt size for Premiership Pick'em last week.It's all in their court.

Yeah, sucks that this happened. As Motley Crue said, it's prob related to SW's recent business changes. Then again, SW has been known to screw us in the past...

Good luck getting this sorted out. Regardless of what you guys get, you should be very proud of your high finishes. Good job, mates!

They have replied to me and state that when they spoke to me before they said it was "most likely" the prize would be $1,000 and now they said they have changed their prizes, this sux and has made me think twice about playing their games in the future, they mess us about so much with their late stats and so on, I know it is free but why state that you will get a prize of $1,000 if they are not going to fulfill that statement. £400 is better than nothing I know but it is the principal of it, I don't want to push it too much in case they turn around and say no to any prize.

excuse me but can they legally do it??....there's a written rule on prizes, and i don't think they can change it after the game ends.....maybe an e-mail by a lawyer will bring you the $1000....how can they turn around?

What can I do ? I do not want to push it because they could turn around and say that I am not having anything then. This is what they said to me that rules stated :

"Per our official rules, top 10 finishers 'will win a Small World Prize Package as determined by Small World in its sole discretion with an ARV of approximately $1,000.'"

Forgive me for being thick but I don't think $600 is worth an ARV of approximately $1,000 is it ? This is just getting worse as I think about it. They say I can still have the TV which is worth $1,000 but it will take 3-4 months or I can have $600 !! There must be something that I can do as this is not right !! Am I wrong in my thinking here ?

Dai - I think the key word in ARV is "retail".

The TV presumably has an approximate retail value of $1000. According to you, they are still offering the TV, but with a delayed shipping date. As an alternative, they are offering you $600 now.

My guess is that the wholesale price of the TV is about $600 (or perhaps wholesale plus shipping costs), and they are simply offering you a cash alternative to the TV. That doesn't sound unfair to me. It also doesn't seem like they should have to offer $1000 as an alternative.

OFFICIAL MATCH RULES TAKEN FROM SMALL WORLD :

"· First through to the Tenth place Overall Finishers with the most total points in the Game over the entire 2000- 2001 Premier League season (excluding any and all post-season play), after the Grand Prize Winner, will win a Small World Prize Package as determined by Small World in its sole discretion with an ARV of approximately $1,000. (ARV of all ten (10) First through Tenth Place Prizes is $10,000.00).

The TOTAL ARV OF ALL PRIZES is $27,350.00. No transfers, alterations, substitutions or cash redemptions permitted by winners. Small World and its Game Partners reserve the right to substitute prizes or cash of like value in the event described prizes are unavailable for any reason. An eligible participant may only receive a maximum of one (1) Weekly prize during each week of the Small World Fantasy Premier League season. Subject to the terms of these Official Rules and Regulations, an eligible participant may also receive only a single prize among the following prizes (whichever of the following prizes has the highest ARV): Overall Grand Prize and the First through One Hundred Fiftieth place prizes.
ADDITIONAL PRIZE INFORMATION: All Winners will be notified by email/mail within 30 days of the Closing Date or in respect of Weekly Winners within 30 days of the end of such week. All Overall Winners may be required to submit valid identification to Small World and to execute those releases Small World deems necessary, without additional compensation, including, but not limited to, an affidavit of eligibility and a liability/publicity release and return the same within fourteen (14) days following issuance of notification. Failure to comply within this time period may result in disqualification. Small World is not responsible for and shall not be liable for late, lost, misdirected or unsuccessful efforts to notify Prize Winners. Guests of these winners may be required to complete travel/liability releases prior to departure. Where a guest is a minor, such minor's parent or legal guardian must be the Overall Prize Winner and must sign releases on minor's behalf. If a prize is declined or undeliverable, the original winner will be disqualified and Small World will select a runner-up. If a member of the Small World Fantasy Premier League community wins a prize that Small World determines in its sole discretion he/she is ineligible to receive, Small World will retain sole discretion as to whether to select a runner-up for such prize.
Grand Prize Winners are responsible for all travel documentation. All Prize Winners are responsible for reporting and payment of all taxes and any other expenses not specified above. Game entrants understand that the Game's results are final in all respects and all decisions regarding the Game, including, but not limited to, selecting potential Prize Winners and awarding prizes, will be made by Small World, whose decisions will be final and binding. Prize Winners consent to the use by Small World and its Game Partners and their respective designees of their names and likenesses for advertising, publicity and promotional purposes in any media, including for use on the Small World Web site, without any additional compensation (except where prohibited by law)."

Now to me, the highlighted parts in bold state that the prize can be changed for a LIKE value !! How can $600 cash be the same as a $1,000 TV ?

Have I got a case here ?

Guru, I appreciate your input, I was hoping that you may be looking at this thread. The only thing that bothers me is that when I spoke to Small World before they confirmed this the only figure they ever mentioned to me was $1,000 cheque and also Motley Crue who finished in the Top 10 of the Brazilian game had a $1,000 cheque instead of a TV, how can this be ?

This "dispute" spilled over into the Baseball Forum, so as a businessman I am going to bring my feelings on the matter into the original thread here.

I have had my "issues" with SW in the past, but the complaints here are completely unjustified!

SW apparently was going to be delayed in getting the $1000 TV. So as Dai stated it, they were essentially telling him "you will have to wait til we can get it, which will be 3-4 months, or we will just give you now the cash that it will cost us to get the TV." Actually that was MORE than they were required to do, and in the business world a generous and reasonable offer.

I see nothing wrong with that offer - if he wants, he can get his $1000 TV when they are able to obtain it. And nothing in their prize offer ever said that they were obliged to SPEND around $1000 for the prize - so their offer to give him immediately what they are spending for the prize (if he wants them to do so) seems more than fair.

This is a free game. They are being VERY fair! I am disgusted with the unreasonable whining and badmouthing of SW here for no reason. ("SW Prize Rip-off" as a thread title????) Grow up!!!!

You are not in my situation so you do not know how I am feeling about this. I am not getting into a slanging match but if you had read what I wrote above then you would see certain statements saying that I am chuffed with $600 BUT the only reason that this problem ever came up was because I have been speaking to SW for the last 4 weeks to ask when the prizes were going to be awarded and the only thing they ever mentioned was that a $1,000 cheque was offered instead of the TV ! Now if that was you then wouldn't you be pissed if they turned around and said that they had cut your prize in approx. half ? Yes you would so I don't think you can tell me what I SHOULD be feeling.

I understand what you are saying but you are in a easy position, most of the people on these boards are people I have spoken to throughout this long season and they know how much work we have put in, it is just a bit of a kick downstairs when things are changed at the last moment. Motley Crue who played the Brazilian game was given a $1,000 cheque instead so I thought this would be the same as the rules were the same, this is where the confusion lies. If someone was going to give you a Ferrari and they give you a Ford you would be so happy but also you would feel a bit gutted wouldn't you ?

I am so so happy with $600 but I have not been given a decent answer as to why $1,000 cash was even mentioned by them if there was no intention to award this.

Thanks for all your input with this guys, I am now going to fax off my info to Small World to get my $600, gotta figure out what to spend it on now !! ;)

Fight your corner,Dai.In simple old UK,retail means retail-the price in the shops.Under UK competition and promotion law if they proposed a cash alternative this would have had to be stated at the outset of the game.God knows what the Scandinavians make of this weasel worded behaviour.
Perhaps like me they remain in the dark.I have had no response to an e-mail posted to prizes at smallworld.Checking my records I also received no notification or prize for 47th in mid-season basketball.
I find Smallworld/TSN's position indefensible.As you say £400 is spendable.
Do you have a name in the new regime at Smallworld as a result of your negotiations?I feel a need to get more aggressive.

I am just fed up with trying to win a no-win battle, like you say, if this game was in good old blighty then we would not be shafted in this way but with them being on the other side of the pond it makes things difficuly. I am thinking twice about playing next year now. I wonder how the 1st place guy enjoyed his half a trip to Japan ? They probably dropped him off in Germany and told him to walk the rest of the way cos they couldn't afford it ;)

The only name I did have was Jeremy Seidman but he has now left SW.

I played the SW premier league tip 'em game and finished 8th (I think). I was told in an email that I would be called about a time for delivery of the TV. I did NOT receive any email saying that it would be delayed 3-4 months. when was this email sent out? was it to all winners?

In regards to the prize, if they told you that they would definitely give you the option of a $1000 cheque then they should stick to that, however if they didn't, then the $600 is justifiable.
Who did you speak to that told you about the $1000 option?

I am very confused as to why I didn't receive the email about the prize options.

I'm just catching up with this. As many of you know, I came onboard after the premiership/brazil games were finished, and am just trying to make sense of things. As I understand it, our legal crew faced many issues with sending cash overseas that I can't even begin to understand. The bottom line is that we wanted to get prizes out the door to people who have been waiting for them, that the process has been less than optimal, and that in the future -- if we're going to run international contests -- we'll need to be much better about setting expectations upfront. As Dai and manly know, I've made my best efforts to set things straight, and I hope to be much more clear in setting prize rules going forward.
